Cal Musselman of Team Musselman (with Dawnell Musselman), of Golden Spike Realty, is a Realtor® and Utah State House Legislator of District 9 in Utah. We share the complaint review & opinion here partially of the investigation by Consumers Financial Protection Advocacy Utah. Which is that Team Musselman (Calvin Musselman & Dawnell Musselman) lied, concealed, and frauded the buyer by NOT telling her the truth about major material issues about a family home (It had been Dawnell’s grandmother’s house and the property had been in Dawnell’s family over 50 years), they were selling to the buyer.

After a review of sales documents, emails, old subdivision map, Davis County Property Tax Records, Davis County, UDOT letters, and Davis County Maps provided at the time of discovery 3 years after the sale and at the parcel auction and other records we find the following to be true:

  1. The Musselman Team knew their family property had been subdivided by their close relative and then the new parcel was lost for non-payment of property taxes so that they buyer effectively got the house, but not the garage and yards, and driveway in this sale. They knowingly caused the buyer extreme difficulty, depression, and expense to resolve or reduce her damages due to these lied about or concealed major issues. Team Musselman directly lied about the garage, yard, and driveways being included in the sale when the buyer requested a walk showing her the boundaries of the property including them.
  2. They knew that the house foundation had been built next to a large buried man-sized six-foot round aqueduct and hid the fact from the buyer. They knew the garage was built illegally over the aqueduct on a Weber Water Easement and hid that fact from the buyer. Such a large aqueduct running near the foundation could cause the house to be destroyed should it deteriorate or an earthquake compromise or damage the aqueduct pipe to leak.
  3. They provided the buyer false information about the rental on the property telling her the area was zoned for the rental unit when they knew it had not been.
  4. They provided the buyer with false information about some paint markings on the street telling her they were to locate utilities when they knew that it really was for UDOT as UDOT had notified their relative they knew they were putting in a freeway next to the property and would be removing and moving the street on the street address of the home first. Street removal caused the noise from Hwy 89 to double as all the landscaping and some topography buffering the sound for the next-door Hwy 89 was removed. At great expense, to the buyer, she built large long dirt berms to try to reduce the sound and vibration inside the house due to this change that Team Musselman had known about this in fact the seller later said that is why he was selling the house before the street changes were made. The street construction started within two weeks of this home sale closing escrow as part of their lying about the overall freeway conversion of the Hwy 89 plan.

It is critical that Real Estate Agents, Realtors®, and their Broker managers are honest and avoid deception of material problems in home sales. With real estate sales commissions averaging over $10,000 a home sale, many agents intentionally mislead buyers for such a large cash windfall.

The dishonesty in this family home sale by Team Musselman (Calvin & Dawnell Musselman) of Golden Spike Realty is absolutely outrageous in our opinion and was fraudulent. It is our conclusion that Calvin Musselman and Dawnell Musselman took advantage of the out of state buyer, a single senior grandmother that had rescued her grandchildren in an 8-year effort to bring them to safety from meth addicts and criminals that abused them, bought the home to move them out of state away from the area of traumatic history. The buyer had adopted them and believed that taking them to this home would be a safe place to bring them and adopt them and for all them to go to heal and recover from the difficulties they had experienced. Instead, the buyer has had years more of severe difficulties and financial losses of her life-savings with efforts to solve problems that the Musselman Team had concealed and lied about in the sale.
